Home/Glossary/Transparency obligations

What is Transparency obligations?

Transparency obligations are legal duties to tell people when they are dealing with AI or AI-generated content. Under Article 50 of the EU AI Act they include informing people they are interacting with an AI system, marking synthetic content, and disclosing deepfakes and emotion recognition or biometric categorisation.

Information must be given clearly at the latest at first interaction or exposure. These obligations apply to certain systems regardless of whether they are high-risk, and are separate from the instructions-for-use information high-risk providers must give deployers. Exceptions exist, for example where AI use is obvious to a reasonably informed person.
