What is Serious incident?

Under the EU AI Act, a serious incident is an incident or malfunction of an AI system that directly or indirectly leads to death or serious harm to health, serious and irreversible disruption of critical infrastructure, an infringement of fundamental-rights obligations, or serious harm to property or the environment.

Article 73 requires providers of high-risk systems to report serious incidents to market surveillance authorities. Deadlines are generally within 15 days of becoming aware, with shorter periods for the most serious cases. Deployers must inform the provider and relevant authorities where required by Article 26. Check the Articles for exact conditions.
